The legislature in order to curb the black money in Indian economy had considered the question of enacting an appropriate legislation for prohibiting benami transactions. As a result of such objects in mind, the legislature had enacted Benami Transactions (Prohibition of the Right to Recover Property) Ordinance, 1988, was promulgated by the President in May, 1988 which was followed by the Act. The 1988 Act prohibits such benami transactions providing imprisonment and fine. Subsequently, the legislature felt that the Act of 1988 had some inherent defects such as absence of provision for vesting the confiscated property with the Central Government, absence of appellate mechanism, etc. and was thus, amended in 2016 to overcome the inherent defects of the 1988.Act.
