Since its initial publication of Competition Act, 2002 Principles & Practices in 2011, the response from readers, scholars, educators and jurists has been humbling as well as encouraging. Considering that the regulatory and jurisprudential environment surrounding Competition Law has undergone considerable transformation, the third edition responds to these evolving developments.
In the last few years, there has been a significant growth of Indian markets and a paradigm shift in the business operation. Responding to these economic developments, emergence of various business models, and the experience gained out of the functioning of the Competition Commission of India, the Competition Act was amended in 2023. The Competition (Amendment) Act, 2023 introduced several key reforms to enhance and encourage the ease of doing business. The amendments included making assessment for combinations, time bound and quicker; introduction of ‘settlement’ and ‘commitment’ framework to reduce litigation; broadened the scope of anti-competitive agreements; hub-and-spoke contents; ‘leniency plus’ provisions, etc. This edition makes full account of all the amended provisions.
In addition to the updated provisions, the case-law have been discussed. All the cases decided by the Supreme Court, High Courts, Appellate Tribunal and the Competition Commission of India since the last edition have been thoroughly studied, and those that are considered helpful in exposition of the principles governing the Competition Law have been embodied at the appropriate places with fair amount of accuracy and precision.
An effort has been made to prepare an inclusive anthology, keeping the basic layout and style of the book intact. Surely, therefore, the book, written in a very simple and lucid style, will make this complex and growing area of Competition Law easily accessible to the Legal Professionals, Regulators, Courts, Students and Researchers.
Dr. V.K. Agarwal obtained his B.Sc., LL.B. and LL.M. from University of Delhi in 1972, 1975 and 1977, respectively. A brilliant scholar during his academic pursuits, he was awarded prizes and merit scholarships for securing positions in LL.B. as well as in LL.M. In 1986, he was awarded Ph.D. in Law by Kurukshetra University. He joined as Lecturer in the Department of Law at Kurukshetra University in 1978 and was elevated as Reader in 1987 and as Professor in 1994. He is a distinguished law teacher and researcher. He has been Chairman, Department of Law; Director, Institute of Law; Dean, Faculty of Law; Dean, Academic Affairs; and Registrar, Kurukshetra University.
He has also served as Deputy Legal Adviser, Ministry of Law and Justice, Government of India, New Delhi. He was Vice Chancellor, Jagan Nath University, Jaipur for more than 6 years, before joining as Pro Chancellor in the same University.
