E-commerce has changed the life and style of common man. E-commerce has changed the way business is done in India. According to a report by Ministry of Commerce & Industry, Government of India, the Indian E-commerce market is expected to grow to US$ 200 billion by 2026. The Government of India has taken many initiatives in the e-commerce sector which are proving a game changer for the sector. The Government’s flagship programmes like Make in India, Digital India, Skill India, Smart Cities and Startup India etc. have raised public faith about the sustained growth of e-commerce sector and has led to huge investment by private sector.
The increased use of internet and penetration of smartphone use in both urban as well as rural areas have further fueled the fast growth of e-commerce in India. The covid-19 outbreak has also contributed in the development of e- commerce due to restrictions imposed by the countries across the world. In India, it has been observed that e-commerce sales spiked by 25% in March 2020. Almost each business segment including online grocery market is growing very fast. The e-retail market is growing at a CAGR of more than 30%. There are many startups in e-commerce sector which have grown leaps and bounds. The investors have shown faith in the e-commerce sector and invested heavily in startups. The growth of e-commerce sector has also contributed in the large employment generation in India.
The e-commerce sector is driven by mainly technology and data which are less regulated and hence, evolving technologies and volumes of data generated require a robust and enabling legal and regulatory frame work. An adequate and proper regulatory framework will empower domestic entrepreneurs, MSMEs, vendors, traders, etc. to the digital ecosystem besides empowering consumers.
There are already sufficient laws and rules which are squarely applicable on e-commerce businesses. However, there are also many grey areas which have come to the notice of the Government. Recently, the Government has taken several steps for removing legal ambiguity in the laws as well as framing new laws and regulations to promote e-commerce and safeguard it. This book is an effort to explain the applicable laws, rules, procedures of law and policy of the Government of India towards ‘E-commerce’ and ‘E-commerce Operators’ operating in India. - CA. Ram Akshya, a Commerce Graduate, is also a Fellow Chartered Accountant having more than 15 years of experience in ‘Tax and Regulatory’ matters. Ram started his professional career with Reliance Industries Ltd., Mumbai as a Manager in their Corporate ‘Legal Compliance Cell’. He then worked with PwC and E&Y in their Indirect Tax practice for more than 6 years. In 2014 & 2015, Ram led the Indirect Tax COE at EY Gurugram. Ram also worked in SS Kothari Mehta & Co. as Director in its IDT practice. Ram started doing own specialised practice in GST and Indirect Taxes in the beginning of 2019 and is expanding it rapidly with his ‘quality delivery’ as well as ‘value added services’.
- Ram’s core specialisation is in GST, Customs, DGFT matters, all India VAT, Excise & Service Tax law. He has worked extensively for Fortune 500 clients. He has also contributed in developing tax technologies/solutions meant for simplifying the tax management and compliances across all segments.
