As you are aware, with a view to reform the traditional agri-market model regulated by state governments and to facilitate better and innovative agri-practices for archaic models, the Parliament passed the three farm legislations in September 2020, namely, The Farmer’s Produce Trade and Commerce (Promotion and Facilitation) Act, 2020, The Farmers (Empowerment and Protection) Agreement on Price Assurance and Farm Services Act, 2020 and The Essential Commodities (Amendment) Act, 2020 (“Farm Laws”), to be implemented retroactively with effect from June 5, 2020.
With both the Farm Laws and the state legislations operating within the same domain, it is imperative to understand the scope of the power of the Centre and the states under these legislations as well as the critical legal issues that have arisen for businesses dealing in agricultural produce, such as the liability to pay market fee to the state governments prior to and post implementation of the Farm Laws.
