The Prevention of Money Laundering Act, 2002 (PMLA) is a crucial piece of legislation enacted by the Parliament of India to prevent money-laundering and confiscate property acquired from money-laundering. The PMLA came into effect on 1st July, 2005 with the primary objective of preventing money-laundering, providing for confiscation of property derived from or involved in money laundering, and punishing those engaged in the commission of the offence of money-laundering. Since its enactment, the PMLA has been amended several times, in 2005, 2009, 2012, and most recently in 2019 through the Finance (No. 2) Act, 2019. These amendments have introduced new concepts and made changes to existing provisions. Although the Supreme Court, in its earlier judgment in Vijay Madanlal Choudhary v Union of India, had stressed upon the judicial principle that the provisions of PMLA must be interpreted in a manner that balances enforcement with individual rights, the same was not followed in its true letter and spirit. However, during the past year, the constitutional courts have taken positive steps to ensure that procedural safeguards are followed while making arrests under the PMLA. For instance, the Supreme Court again revisited the issue pertaining to the manner in which an arrested person is informed of the grounds of their arrest under Section 19 of the PMLA in Pankaj Bansal v Union of India.

The recent developments necessitated a fresh and comprehensive analysis of PMLA's evolving legal landscape. The second edition of the book "Treatise on PMLA Law and Practice" aims to provide an updated, in-depth analysis of the recent judicial interpretations, offering readers an insightful perspective on the application of law and its interpretation. The majority of the chapters have been revised to include the latest case laws, legislative amendments, and notifications issued by regulatory authorities. Given the complexities surrounding the interpretations of the provisions of the PMLA, legal professionals, academicians, and law enforcement authorities need to stay abreast of the developments.
